1. Definitions
VayCay — the provider of digital travel planning services.
User — any person who uses the Service.
Service — the creation of a personalised day-by-day travel itinerary.
Itinerary — a digital document containing suggestions, recommendations, and indicative information.
2. Nature of the Service
2.1 VayCay provides informational and advisory services only.
2.2 VayCay is not a travel agency or tour operator. We do not sell flights, accommodations, tours, or any other travel products.
2.3 The Itinerary constitutes non-binding advice based on the information provided by the User.
3. Formation of the Agreement
3.1 The agreement is formed upon successful payment of €19.99.
3.2 By placing an order, the User explicitly agrees to these Terms & Conditions.
3.3 Delivery takes place digitally, by email, in PDF format.
4. Pricing and Costs
4.1 The price of €19.99 covers the Itinerary only.
4.2 All prices, availability, and costs mentioned in the Itinerary (including flights, hotels, and activities) are:
- indicative
- subject to change
- dependent on third-party providers
4.3 VayCay does not guarantee that the prices listed will actually be available at the time of booking.
5. No Guarantee of Availability
5.1 VayCay is not responsible for:
- price changes
- sold-out accommodations
- changes to schedules or services
- changes made by third parties
5.2 The User is solely responsible for verifying details and making any bookings.
6. Liability
6.1 VayCay is liable only in cases of intent or gross negligence.
6.2 Any liability is limited to a maximum of the amount paid (€19.99).
6.3 VayCay is not liable for:
- indirect damages
- consequential damages
- missed bookings
- price differences
- disappointments in the travel experience
6.4 Use of the Itinerary is entirely at the User’s own risk.
7. Managing Expectations
7.1 The Itinerary is intended as inspirational and personalised advice. It is not a guarantee of any specific experience.
7.2 Subjective terms such as “best,” “most beautiful,” or “recommended” reflect general insights and preferences, not objective facts.
7.3 VayCay does not guarantee that the trip will match every individual expectation.
8. Revisions and Refunds
8.1 The User is entitled to one (1) free revision of the Itinerary, provided the request is submitted within 7 days of delivery and is based on one or more of the following grounds:
- the Itinerary contains a clear factual error (such as a misnamed location, incorrect opening hours, or a closed venue)
- the Itinerary does not reflect the information provided by the User in the intake form (for example, recommendations conflict with stated dietary needs, accessibility requirements, budget, or pace)
- the Itinerary contains content that is incomplete in a way that materially affects its usability
8.2 Revision requests must be submitted in writing to info@vaycayworld.com and must specify the grounds in concrete detail. Vague or unsubstantiated dissatisfaction does not qualify as a valid ground for revision.
8.3 The following do not qualify as grounds for revision or refund:
- a general preference for different recommendations
- a desire to change the destination, dates, or other parameters after delivery
- subjective disagreement with suggestions, atmosphere, or tone
- changes in personal circumstances after the Itinerary was delivered
- price differences between the indicative figures in the Itinerary and current market prices
8.4 If, after the revision, the Itinerary still demonstrably fails to meet the original input or contains substantive errors, the User may request a full refund of €19.99. Refunds are issued at VayCay’s discretion based on the merits of the case.
8.5 The right to revision is limited to one (1) revision per Itinerary. Subsequent change requests fall outside the scope of the original agreement and may be offered as a paid service at VayCay’s discretion.
9. Right of Withdrawal
9.1 By placing an order and ticking the box marked “I agree to immediate performance of the service and waive my right of withdrawal,” the User consents to immediate performance of the digital service.
9.2 The User thereby waives the right of withdrawal, in accordance with European consumer law (Directive 2011/83/EU, Article 16(m)).
9.3 This waiver does not affect the User’s rights under Section 8 (Revisions and Refunds).
10. Intellectual Property
10.1 All Itineraries and content provided by VayCay are the intellectual property of VayCay.
10.2 It is not permitted to copy, distribute, or use commercially any part of the Itinerary or content without prior written consent from VayCay.
10.3 The User may use the Itinerary freely for their own personal travel purposes.
11. Force Majeure
11.1 VayCay is not liable for delays or shortcomings caused by force majeure, including but not limited to:
- technical failures
- external data issues
- illness
- government measures
12. Applicable Law
12.1 These Terms & Conditions are governed by Dutch law.
12.2 Any disputes shall be submitted to the competent court in the Netherlands.
